Application For Import Licence
I. General documents and materials to be submitted for import licence.
(1) the general documents and materials provided by various import and export enterprises to the licensing authorities when applying for import licenses:
1. application form for import license.
The application form (original) should be clearly written and stamped with the official seal of the unit.
The contents must be standardized.
2. apply for the official letter of the unit or the work permit of the applicant; the agent shall produce a letter of entrustment from the entrusted unit.
3. a non foreign trade unit, which refers to an organ, a group and an enterprise or institution without the right to operate foreign trade, shall apply for an import licence to provide evidence of its competent department (above the division or bureau level).
4. the first application unit of the import license shall provide the Ministry of foreign trade and economic cooperation or the authorized department of foreign trade and economic cooperation to approve the import and export operation rights of the enterprise (copy of the original).
5. the first time a foreign investment enterprise applies for an import license, it shall provide the government's competent department for approval of the enterprise's approval certificate and business license (photocopy), archiving and filing by the license issuing organ.
(two) import under general trade should also submit the following materials separately:
1. quota management of imported commodities: mechanical and electrical products shall be submitted to the import Office of the National Office of mechanical and electrical products (hereinafter referred to as the state electrical and mechanical office) issued the "import quota certificate"; general merchandise should be submitted to the State Planning Commission authorized by the quota management department issued the "general merchandise import quota certificate".
2. non quota management of imported commodities: grain, vegetable oil, pesticides, wine and color sensitive materials should be submitted to the import registration department authorized by the State Planning Commission for import and export registration certificate of specific commodities; carbonated drinks should be submitted to the State Economic and Trade Commission for import certificates; military and civilian chemicals should be submitted to the Ministry of chemical industry; the precursor chemicals should be submitted to the Ministry of foreign trade and economic cooperation.
(three) the foreign investment enterprises shall submit the following documents and materials separately when applying for import licenses:
1. the general merchandise imported by foreign invested enterprises as a quota for the purpose of investment and self use shall be submitted to the list of imported equipment and materials approved by the competent departments of foreign trade and economic cooperation. If importing special registered commodities under license management, the list of imported equipment and materials approved by the competent departments of foreign trade and economic cooperation shall be submitted.
2. foreign invested enterprises shall import general merchandise subject to quota management for the production of domestic products. They should submit certificates of import quotas for foreign invested enterprises issued by the competent departments of foreign trade and economic cooperation, and import specific registered commodities for the production of domestic products. They should be submitted to the foreign trade and economic cooperation departments for the import registration certificate of specific commodities of foreign invested enterprises.
3, foreign invested enterprises shall import the refined oil as investment, self use and domestic sales products, and submit the certificate of general merchandise import quotas issued by the import quota administration department authorized by the State Planning Commission.
4. the import and export quotas issued by the state electrical and mechanical office shall be imported to foreign invested enterprises for the import of mechanical and electrical products subject to quota management for the production of domestic products.
(four) the documents and materials submitted by overseas Chinese, Taiwan, Hong Kong and Macao compatriots to apply for import licenses should also be submitted separately.
1. general merchandise import under quota management shall be submitted to the import quota administration department authorized by the State Planning Commission for issuing the general merchandise import quota certificate.
Import of grain, vegetable oil, pesticides, wine and color sensitive materials shall be submitted to the import registration department authorized by the State Planning Commission for the import registration certificate of specific commodities.
2. the electromechanical products stipulated by the State Council for the implementation of quota management shall be submitted to the provincial and Municipal Overseas Chinese offices for approval documents.
The mechanical and electrical products of the State Council that do not limit the import license management shall be submitted to the state electrical and mechanical office for the certificate of import quotas.
(five) the documents and materials to be submitted for import licence under other trade modes:
1. other modes of trade include compensation trade, border trade, foreign government loans or loans from international financial organizations, free assistance from international organizations or governments, economic and trade exchanges, China's foreign institutions and labor contracts returned, raw materials processing or import processing, mechanical and electrical equipment for import or export, and so on.
2. quota management of mechanical and electrical products should be submitted to the state electrical and mechanical office issued the "export quotas".
3. quota management of general commodities, the application unit shall submit a certificate of general merchandise import quota issued by the quota management department authorized by the State Planning Commission.
Import of grain, vegetable oil, pesticides, wine and color sensitive materials shall be submitted to the import registration department authorized by the State Planning Commission for the import registration certificate of specific commodities.
(six) documents and materials to be submitted for import licence under leasing trade;
Quota management of mechanical and electrical products should be submitted to the state electrical and mechanical office issued quotas for import quotas.
Non quota management of mechanical and electrical products should be submitted to the Department of behavior management departments and the leasing company's internal and external leasing contracts.
Two, import license application form content specification
Every unit that applies for an import license shall fill in the application form of the import license according to the following specifications.
(1) importers: the names and codes of import and export enterprises approved or approved by MOFTEC should be filled out.
The import and export of foreign invested enterprises should also include the names and codes of the companies. When importing non foreign trade units, they should fill in the "self purchase" code, which is "00000002". If they accept foreign donations, they should fill in the "gift" and encode it as "00000001".
(two) consignee: the quota quota unit should be filled, and the quota unit should be consistent with the approved quota certificate.
(three) import license No.: issued by the issuing authority.
(four) the effective expiration date of the import licence is generally one year (except otherwise stipulated).
(five) mode of trade:
The contents of this column are: general trade, barter trade, compensation trade, agreement trade, import processing, raw material processing, foreign investment enterprise import, international lease, international loan import, international assistance, international bidding, international exhibition, international auction, donation, presentation, border trade, licensing trade, etc.
(six) the source of foreign exchange:
The contents of this column are: Bank purchase, foreign investment, loan, gift, claim, gratuitous aid, labor service, etc.
Foreign invested enterprises, such as import, lease, etc., fill in "foreign capital", and the "labor service" should be filled in for the management of goods and public goods by import licenses repatriated by foreign contracting projects and foreign agencies.
(seven) customs declaration port: the port of entry should be filled.
(eight) exporting countries (regions): foreign countries (regions).
(nine) country of origin: it should fill in the countries and regions where the goods are processed in a substantive manner.
(ten) commodity use: can be filled: self use, production, domestic sales, maintenance, samples, etc.
(eleven) the name and coding of commodities shall be completed in accordance with the catalogue of commodities imported by the Ministry of foreign trade and economic cooperation promulgated by the Ministry of foreign trade and economic cooperation.
(twelve) specifications and models: only 4 types of the same coding commodity with different specifications and types can be filled, and more than 4 models should be filled out separately.
(thirteen) units: units refer to units of measurement.
The units of measurement for the use of commodities shall be uniformly prescribed by MOFTEC and shall not be arbitrarily changed.
When the unit of measurement used in the contract is inconsistent with the prescribed measurement unit, it should be converted into a unified unit of measurement.
For non restricted imports, this column takes "set" as the unit of measurement.
(fourteen) quantity: it should be completed in accordance with the unit of measurement stipulated by MOFTEC, and a fractional number is allowed.
(fifteen) unit price (Bi Zhi): it should fill in the price or estimated price at the time of the paction and be consistent with the unit of measurement.
Three. Modification, extension and loss handling of import licences
(1) after all import and export enterprises have obtained the import license, they should handle the import license changes or postpones according to the following requirements:
1. the application unit should change the import license for any reason, and it should be carried out within the validity period.
The application unit should fill in the application form for import license change, fill in the form clearly in the form, and hand in the original license issuing authority with the original license first, second.
2. the importer, the receiving unit, the name, specification and quantity of the goods should be changed, and the import license must be re applied.
3. the period of validity of the import license needs to be postponed. The application unit should normally make an application within the validity period and provide an import contract.
If the import contract is indeed signed, the license issuing authority may extend the extension according to the circumstances. The longest delay is six months, and no extension can be made after the extension. If the contract is not signed during the validity period, the extension shall not be applied again.
(two) if the applicant has lost the license, it should report the loss to the issuing authority and the customs port of the certificate in time.
After the examination of the certification authority is really lost, it shall be handled according to the regulations.
Four, the legal responsibility of applying for a unit.
The applicant shall not forge, alter or buy or sell import licences. The violator shall be investigated for criminal responsibility in accordance with the foreign trade law of the People's Republic of China and customs regulations.
